SOFTWARE TERMS OF SERVICE

1. Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the Uniweld SmarTech™ FUSION mobile application, related firmware, cloud services, and connected hardware devices (collectively, the “Service”), provided by Uniweld Products, Inc. (“Uniweld,” “we,” “us,” or “our”).

By creating an account, accessing, or using the Service, you agree to be legally bound by these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to use the Service.

 

2. Professional-Use Notice

The FUSION App is designed for trained HVACR professionals.

You acknowledge that:

  • HVAC systems involve high pressure, high voltage, refrigerants, and potentially hazardous conditions.
  • Improper interpretation of pressure, temperature, superheat, subcooling, vacuum, or other readings may result in equipment damage, refrigerant loss, property damage, personal injury, or death.
  • You are solely responsible for verifying all measurements before taking action.

The Service is a tool. It does not replace professional judgment.

 

3. License Grant

Uniweld grants you a limited, non-exclusive, non-transferable, revocable license to use the Service solely for lawful professional purposes.

You may not:

  • Reverse engineer or decompile the software
  • Modify or create derivative works
  • Resell, sublicense, or distribute the Service
  • Circumvent security features
  • Use the Service in violation of export laws

All intellectual property remains owned by Uniweld.

 

4. Account Registration

You agree to:

  • Provide accurate registration information
  • Maintain account confidentiality
  • Be responsible for all activities under your account

We may suspend or terminate accounts for misuse or violation of these Terms.

We may limit the number of devices connected to one account.

 

5. Connected Hardware Disclaimer

The Service may connect to wireless probes, vacuum gauges, pressure sensors, pipe clamps, and other HVAC instrumentation.

Measurement accuracy may be affected by:

  • Calibration issues
  • Environmental conditions
  • Signal interference
  • Improper installation
  • Battery condition
  • Physical damage

You are responsible for ensuring devices are properly installed, calibrated, and maintained.

Uniweld is not responsible for system damage resulting from incorrect readings, delayed readings, or communication failure.

 

6. No Warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

Uniweld disclaims all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy of data
  • Continuous availability

We do not guarantee:

  • Error-free operation
  • Uninterrupted service
  • That the Service will prevent equipment failure

 

7. Limitation of Liability

To the maximum extent permitted by law:

Uniweld shall not be liable for:

  • Personal injury or death
  • Refrigerant loss
  • System failure
  • Compressor damage
  • Electrical damage
  • Property damage
  • Loss of profits
  • Business interruption
  • Data loss

Total liability shall not exceed the greater of:

(a) $50 USD
or
(b) The amount paid for the Service in the past 12 months.

This limitation is an essential basis of the agreement.

Some jurisdictions may not allow certain exclusions; in those cases, liability is limited to the maximum permitted by law.

 

8. Indemnification

You agree to defend, indemnify, and hold harmless Uniweld from any claims arising out of:

  • Your misuse of the Service
  • Your HVAC service decisions
  • Your violation of the law
  • Your breach of these Terms

 

9. Data Ownership and Usage

The FUSION App processes measurement data locally on the user’s device for real-time display and calculation purposes.

Uniweld does not:

  • Store measurement logs on its servers
  • Retain user-generated system data
  • Aggregate field measurement data
  • Use measurement data for analytics or AI training
  • Sell or monetize user measurement data

If users export, share, or back up data, such actions occur at the user’s direction and responsibility.

Uniweld may collect limited technical information necessary for app functionality, such as:

  • App version
  • Device model
  • Operating system version
  • Crash diagnostics

Such technical data does not include HVAC system measurement data.

Use of any personal information is governed by the Privacy Policy.

 

10. Automated Calculations Disclaimer

The Service may perform automated calculations such as:

  • Superheat
  • Subcooling
  • Saturation conversions
  • Pressure/temperature relationships
  • Target calculations

These outputs are informational tools only.

Uniweld does not guarantee the accuracy of calculations under all field conditions. Final responsibility for service decisions rests solely with the technician.

 

11. Apple App Store Terms (iOS Users)

If downloaded via Apple:

  • This agreement is between you and Uniweld, not Apple.
  • Apple has no responsibility for the Service.
  • Apple is a third-party beneficiary of these Terms.
  • Warranty claims are limited to the extent permitted by law.

You represent that you are not located in a U.S. embargoed country.

 

12. Export Compliance

You agree not to use or export the Service in violation of U.S. export laws or international sanctions.

 

13. Termination

We may suspend or terminate access:

  • For violation of Terms
  • For misuse
  • For legal compliance
  • For business discontinuation

Sections relating to liability, arbitration, indemnification, and IP survive termination.

 

14. Dispute Resolution – Binding Arbitration

All disputes shall be resolved by binding arbitration under the Federal Arbitration Act.

Arbitration shall be conducted in Florida, USA.

You waive the right to:

  • Jury trial
  • Class action participation

You may opt out of arbitration within 30 days of first accepting these Terms by written notice.

Either party may bring individual claims in small claims court.

 

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

 

16. Changes to Terms

We may update these Terms.

Continued use after updates constitutes acceptance.
